Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of Finding Yoga (the "Service"), operated by Trident Partners Co. ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

2. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

• Use the Service to publish content that is unlawful, harmful, harassing, defamatory, fraudulent, or infringes the rights of others
• Misrepresent your identity, credentials, or affiliation with any person or organization
• Attempt to disrupt, compromise, or gain unauthorized access to the Service, our infrastructure, or other users' accounts
• Use automated means (bots, scrapers, crawlers) to access the Service except as expressly permitted
• Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service
• Resell, sublicense, or redistribute access to the Service without our written consent

3. Accounts

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at support@tridentpartners.co if you suspect unauthorized access.

4. Account Termination

You may cancel your account at any time from your dashboard or by contacting support. We may suspend or terminate your account, with or without notice, if you breach these Terms, fail to pay applicable fees, or use the Service in a way that creates risk or legal exposure for us or other users. Upon termination, your right to use the Service ends immediately. We may retain limited records as required by law or as described in our Privacy Policy.

5. Subscriptions and Fees

Paid plans are billed in advance through Stripe. Fees are non-refundable except where required by law. We may change pricing with reasonable advance notice; changes apply at the start of your next billing cycle.

6. Content and Intellectual Property

You retain ownership of content you upload to the Service (text, images, schedules, contact data). You grant us a non-exclusive, worldwide license to host, display, and process that content as necessary to operate the Service. Templates, code, and platform components remain our property or that of our licensors.

7. Limitation of Liability

To the maximum extent permitted by law, Trident Partners Co. and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunity, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim relating to the Service shall not exceed the greater of (a) the amounts you paid us in the twelve months preceding the claim, or (b) one hundred US dollars ($100). The Service is provided "as is" and "as available," without warranties of any kind, express or implied.

8. Indemnification

You agree to indemnify and hold harmless Trident Partners Co. from any claims, damages, or expenses arising from your content, your use of the Service, or your breach of these Terms.

9. Governing Law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of laws principles. You agree that the state and federal courts located in Bernalillo County, New Mexico shall have exclusive jurisdiction over any dispute that is not subject to the dispute resolution process below.

10. Dispute Resolution

Before filing a claim, you agree to attempt to resolve the dispute informally by contacting us at legal@tridentpartners.co. If we cannot resolve the dispute within sixty (60) days, either party may pursue the dispute through binding individual arbitration administered under the rules of the American Arbitration Association in Albuquerque, New Mexico, except that either party may seek injunctive relief in court for intellectual property matters. You and Trident Partners Co. each waive the right to a jury trial and to participate in a class action.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced by email or in-product notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
